US Judge Mandates Release of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The situation originates in a erroneous deportation to El Salvador in March, which the government later acknowledged was an mistake. Following his repatriation to the United States to face human smuggling charges, he was held in federal custody.
In her decision, the judge noted that the government lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
Background of the Case
The legal proceedings involve conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.
He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in the state of Tennessee.
Terms of Freedom
The judge, who was overseeing his challenge to removal in a federal court, determined that he must now comply with the conditions of his release from custody in Tennessee. This decision shifts his monitoring to the Tennessee court.
This ruling represents a notable development in a complicated immigration case involving claims of mistaken imprisonment and contested gang affiliations.
